Get help in preparing your victim impact statement

If you were the victim of a person found not criminally responsible, you can ask for help in preparing your victim impact statement.

Do not hesitate to ask someone you know and trust or a victim support resource for support. If you can read in French, you may also find this Guide de déclaration de la victime very helpful.

Obtain support at the hearing

Most CETM hearings are public. You are therefore free to attend with someone you trust—or even several people. You do not need to ask for permission to do so.

If you have no one to accompany you, don’t hesitate to ask a victim support resource for help. This service is offered free of charge.

Request accommodations at the hearing

If you fear for your safety, you may request accommodations prior to the hearing. A screen can be set up, for example, to prevent you from seeing the accused (and vice versa). 

The CETM assesses this type of request on a case-by-case basis.

Obtain the complete CETM decision

If you so request, the CETM must send you all decisions regarding the accused. These decisions will be redacted, however, which means that some of their content will not be legible.

You can find complete, unredacted CETM decisions on the SOQUIJ website. On the site, you need to select a specific tribunal or body, but the CETM does not appear in the drop-down list. To access CETM decisions, select Tribunal administratif du Québec (TAQ), Affaires sociales.

You can ask a legal clinic, such as one of the Community Justice Centres (CJP), for assistance in doing this kind of search.

Inform the CETM of any change in your contact information

If you have moved and/or changed your telephone number, be sure to provide the CETM with your new contact information to ensure that you continue to receive the information to which you are entitled.

This information tool is for anyone who has been the victim of a crime committed by a person found unfit to stand trial or not criminally responsible due to a mental disorder, and who is involved with the CETM.

Designated hospital

A designated hospital is the place where people found unfit to stand trial or not criminally responsible are:

  • detained
  • treated
  • evaluated

There are more than 40 designated hospitals in Quebec, with varying levels of security.

Party / Parties

Being party to a hearing means participating actively in the proceedings. Parties are allowed to present evidence and plead their case.

Prosecuting attorney

The prosecuting attorney is the lawyer who represents the DPCP or the municipal court.
