If you have been the victim of a crime, you may have just learned that the accused has been found unfit to stand trial or not criminally responsible on account of mental disorder.

 We have created this site for you and those close to you.

Whether you know the person who committed the crime or not, what you are currently going through can be complicated and very difficult. This is to be expected. Recovering from a crime or seeing someone we love suffering the consequences of victimization demands energy and courage.

Your rights

You have rights. The purpose of this site is to help you ensure those rights are respected before the Commission d’examen des troubles mentaux or CETM.

Information

Dealing with the CETM means becoming familiar with a tribunal that is little known to the general public. If you are apprehensive about the process, take the time to get informed. Having the information you need will give you tools to help you to deal with a situation that is unfamiliar to you.

Designated hospital

A designated hospital is the place where people found unfit to stand trial or not criminally responsible are:

  • detained
  • treated
  • evaluated

There are more than 40 designated hospitals in Quebec, with varying levels of security.

Party / Parties

Being party to a hearing means participating actively in the proceedings. Parties are allowed to present evidence and plead their case.

Prosecuting attorney

The prosecuting attorney is the lawyer who represents the DPCP or the municipal court.
